1. Platform Role

RaceSelect is a technology platform that facilitates:

• Event listings
• Participant registration
• Payment processing
• Digital waiver execution
• Event communications
• Timing, scoring, and results display

RaceSelect does not organize, operate, supervise, or control race events. All events are operated by independent event organizers (“Organizers”).

2. Registration on Behalf of Others

Registration may be completed by:

• A participant
• A parent or legal guardian
• A coach or team representative
• An authorized agent

If you register a participant (adult or minor), you represent and warrant that:

• You have legal authority to act on their behalf
• You have authority to agree to these Terms and applicable waivers
• All submitted information is accurate

If registering a minor, you represent you are the minor’s legal parent or court-appointed guardian with authority to consent.

RaceSelect may rely on these representations and is not responsible for independently verifying authority.

3. High-Risk Activity Acknowledgment

By registering for or participating in an event, you acknowledge:

• Participation is voluntary
• All risks are assumed by the participant
• RaceSelect is not responsible for event safety, track conditions, officiating, or operations

RaceSelect has no control over event execution.

4. Organizer Responsibility

Organizers are solely responsible for:

• Event safety and operations
• Rules and eligibility decisions
• Technical inspections
• Insurance coverage
• Refund policies
• Waiver drafting and enforceability
• Compliance with applicable laws and sanctioning rules

RaceSelect is not liable for Organizer actions or decisions.

5. Payments

Payments are processed by third-party providers (including Stripe).

• RaceSelect does not store full credit card numbers.
• Organizers may pass through processing fees.
• Refunds are determined solely by the Organizer.

RaceSelect is not responsible for payment disputes or chargebacks.

6. Waivers

RaceSelect provides digital waiver execution and storage tools.

RaceSelect:

• Does not provide legal advice
• Does not guarantee enforceability
• Does not verify guardian authority beyond provided representations

Organizers are solely responsible for waiver legality and compliance.

7. Public Competition Data

Motorsports results are public by nature. By registering, you acknowledge that:

• Names
• Team affiliations
• Class information
• Results, rankings, and lap times

may be publicly displayed and permanently archived.

8. Media & Sponsor License

By registering for or participating in an event, you grant the Event Organizer, its sponsors, sanctioning bodies, and RaceSelect a perpetual, worldwide, royalty-free license to use the participant’s name, image, likeness, voice, results, and biographical information in photographs, video, livestreams, broadcasts, promotional materials, advertising, social media, and archival content related to the event or motorsports activities, without compensation or further approval.

If registering on behalf of another person, you represent that you have authority to grant this license on their behalf.

9. Insurance (Organizers)

Organizers represent that they maintain commercially reasonable insurance appropriate for motorsports events.

RaceSelect is not an insurer and does not verify coverage.

Organizers agree to indemnify RaceSelect for claims arising from event operations.

10. Limitation of Liability

To the maximum extent permitted by law:

RaceSelect is not liable for:

• Personal injury or death
• Event cancellations or delays
• Disqualifications
• Rule disputes
• Organizer negligence
• Insurance disputes
• Lost profits, sponsorships, or prize money

RaceSelect shall not be liable for indirect, consequential, incidental, or punitive damages.

11. Indemnification

Organizers agree to indemnify and hold harmless RaceSelect from claims arising from:

• Event operations
• Participant injury
• Youth participation
• Failure to maintain insurance
• Improper waiver implementation

Users registering on behalf of others agree to indemnify RaceSelect if they lacked proper authority to bind the participant.

12. Arbitration & Governing Law

Any dispute arising out of or relating to the Service or these Terms shall be resolved by binding arbitration administered by the American Arbitration Association.

• Venue: Kentucky
• Single arbitrator
• No class actions
• Jury trial waived

These Terms are governed by the laws of the Commonwealth of Kentucky.

RaceSelect may seek injunctive relief in Kentucky courts when necessary.

13. Changes

RaceSelect may update these Terms at any time. Continued use constitutes acceptance of changes.
